There has been a lot of hell raising, law passing, and executive ordering since some idiot killed a bunch of kids in a school. It brought all of the emotions, on both sides of the question of gun control, out of the wood work. But the fact is this, the second Amendment says that we, the people, are allowed to bear arms. It does NOT say what kind of arms are allowed, or how many arms are allowed, or how much ammunition for those arms are allowed.
Yet local, state, and federal laws are being passed regulating just such things. IMO all of those laws are illegal and unconstitutional. If people wish to put limits on the term "to bear arms" then they first have to change the second amendment.
In order to do that the proper procedure must be followed. Otherwise we have anarchy.
!) Either Congress or the States can propose an amendment to the Constitution.
. Both Houses of Congress must propose the Amendment with a two-thirds vote.
. Two-thirds of the State legislatures must call on Congress to hold a constitutional Convention.
RATIFY AN AMENDMENT
Regardless of how the amendment is proposed, it must be ratified by the States
.Three-fourths of the State legislatures must approve of the amendment proposed by congress, or
. Three-fourths of the states must approve the amendment via ratifying conventions. (This method has only been used once, to repeal Prohibition; 21st amendment.
The timetable for ratification has been set at seven years.
Only 33 amendments have received a two-thirds vote from both houses of congress. Of those, only 27 have been ratified by the States.
So it is not an easy thing to amend our constitution. It was made that way on purpose so that the heat of the moment would not hasten the approval of BAD laws.
